Probate:
Experiencing the loss of a loved one is one of life’s most difficult and painful hurdles. When that loved one has not established and secured an estate plan in advance of his or her passing, family members are often faced with the task of putting the loved one’s affairs in order; this typically involves opening a probate proceeding so as to legally transfer assets from the decedent’s name to the names of his or her legal heirs. Probate is a time consuming and costly enterprise which is best avoided by advance estate planning. If the decedent’s estate plan included only a will and no trust, and, their assets were not pre-designated in the names of their beneficiaries, the probate court will need to order appointment of an administrator/personal representative, verify the validity of the
decedent’s will, inventory and appraise estate property, assess and assign creditor claims, pay debts and taxes, and finally, distribute assets either by the terms of the will or by designation of legal heirs. Handling this process can be overwhelming and involve a great deal of time; for this reason most family members select a trustworthy attorney to handle probate on behalf of their deceased loved one.
